Prodaff supports an employer’s timekeeping and recordkeeping process. It does not provide legal advice or guarantee FLSA compliance.
What Are the FLSA Timekeeping Requirements?
Under the Fair Labor Standards Act, employers must maintain accurate records for covered, nonexempt employees.
These records generally include:
- Hours worked each day
- Total hours worked each workweek
- The time and day the workweek begins
- The employee’s regular hourly pay rate
- Straight-time and overtime earnings
- Additions to or deductions from wages
- Total wages paid
- The pay period and payment date
The US Department of Labor does not require employers to use a specific timekeeping system. Employers may use paper timesheets, time clocks, designated timekeepers, or digital time-tracking software, provided the records are complete and accurate.
Recording and Retaining Time Are Different Responsibilities
Recording means capturing complete and accurate information about employee hours and wages.
Retention means preserving each category of record for the required period.
| Record category | General federal retention period |
|---|---|
| Payroll records, collective bargaining agreements, and certain sales and purchase records | At least 3 years |
| Timecards, work schedules, wage-rate tables, and other wage-computation records | At least 2 years |
State and local laws may require additional information or longer retention periods. Employers should review the requirements that apply wherever their employees work.
